General terms and conditions of sale

1- Preamble

The following conditions are concluded between
-Soft-Creation, RCS Evry 501 592 141
Head office : 6, Avenue de la Charmille - 91390 Morsang/Orge - FRANCE
and
-Individual or company wishing to purchase "Barcode Express" software.

The parties agree that the present conditions of sale, available on the day of the purchase, exclusively govern their relationship.

2- Pricing

- The prices are quoted in US dollar(USD) and in Euro (EUR), including all taxes (VAT not applicable, article 293B of the CGI)
- All orders are payable in US Dollars or Euro

3- Licenses

Two types of licenses are available :
- "Site license" allowing the installation of the full version on an unlimited number of computers within the same physical site location.
- "Single license" allowing the installation of the full version on a single computer.

In the first case "Site license", the Customer can install the full version on an unlimited number of his own machines. The full version can always be reinstalled (whether for a change of PC or reinstallation of Windows) as long as the installation takes place on the same physical site (same geographical location) and the machines belong to the customer.
The full version is always active, without any time limit (i.e. the purchase of the license is definitive, there is no subscription to pay)
The customer will have to keep a backup of the installation file, because no duplicate of the program can be delivered beyond 1 year after the purchase date.

In the case of "Single license", customer receives an activation code allowing the activation on 1 computer. The code is only valid on the device from which the order was placed. In case of a change of equipment before the end of the 1-year technical support period, a new code can be issued free of charge on request (but this does not constitute a right for the customer).
The customer will have to keep/store his activation code, as we do not keep customers data beyond 1 year, and it cannot be reissued after this term.

4- Refund policy and conditions

The main benefit of electronically distributable software is that software functionality and features can be fully tested prior to purchase using the trial version. Trial version has same features as paid version - the only difference is that trial version has limitations : 10 launches allowed and maximum of 15 labels can be printed in one print run.
If you still have questions after testing the trial version please contact us at contact@soft-creation.fr before purchasing the product.
At Soft-Creation sole discretion, we will refund the purchase price for orders which fall into the following categories:
-The product has been proven to be defective by Soft-Creation technical support department.
-Duplicate orders that have only been made at the Soft-Creation store.

5- Property

The software is protected by the intellectual property law applicable in France, international conventions and treaties relating to copyright and any other applicable law.Aucun droit de propriété n’est conféré à l’utilisateur au titre de la licence, seul un droit d’utilisation est concédé à l’utilisateur.

The customer is allowed to use the software for his personal use (individual or company), but cannot sell, rent or give it to a third party.

6- Technical support

Technical support is available free of charge for one year from the date of purchase. Customer Support is available by email only, at contact@soft-creation.fr
Excluded services :
Technical support does not include, but is not limited to: problems related to your equipment (printer, hand scanner...), problems related to the Windows framework or files, problems related to antivirus, firewall or other blocking the operation of our software, specific developments, remote control. No assistance will be provided in case of software modification or the use of hardware/system configuration contrary to the recommendations of Soft-Creation.

7- Responsibility

The use of the software is the responsibility of the customer. Soft-Création cannot be held responsible for any error or loss of data.
Any software may have defects ("bug"), Soft-Creation will do all that is in its capacity to correct them, but the user will not have to make the reproach to Soft-Creation.
The total or partial impossibility of using the products, in particular due to incompatibility of materials, cannot give rise to any compensation or refund.
Soft-Creation will not incur any liability for any immaterial and indirect damage as a result of these conditions, namely: operating loss, loss of profit, loss of opportunity, which could arise from the purchase or the use of its software.

8- Software updates

Any updates are available free of charge for one year from the date of purchase.
It is the customer's responsibility :
-to check the availability of new versions on the web page https://www.soft-creation.com. Updates (new versions) are then delivered on request, in a dematerialised way (by download) only during the period of one year from the date of purchase.
-to keep a backup of the new versions delivered and install the update in accordance with the licence agreement. No duplicates can be provided.

9- Applicable law and jurisdiction

These conditions are governed by French law and any dispute or litigation which may arise from the interpretation or execution of these will be the exclusive jurisdiction of the courts on which the head office of the company Soft-Creation depends. The reference language for the settlement of any disputes is French.
